--- provided copies related to the damaged claimed shipment, copies attached, and provided a narrative of the events related to this claim.
The scenario of this shipment was related as follows:
All prior, and this shipment included, of similar items from the Manufacturer are loaded on “Rolltite” trailers and the cargo secured in accordance with the Shipper’s requirements. “Rolltite” trailers are describers as being flat rack trailers with bowed frames that are covered with tarpaulins, also known as “Conastogga” trailers.
However, it was advised the two (2) units were to be loaded on open flat rack trailers. This was not acceptable and the Forwarder was advised only a “Rolltite” trailer could be loaded. This was reported to have been accomplished when the units left the Shipper’s facility in Ontario. When delivered, the two (2) units were on an un-covered flat rack trailer and the securing had been changed.
Strapping had now been placed over the tops of the frames of the dishes, not over the skids to which they were secured. In addition, there were foot prints present of the faces of the dishes, as shown in photographs #’s A-H. --- stated the driver was wearing footwear that had the same footprint as the marks shown on the dishes however he denied walking on them.
The units were installed on the trailer assemblies used in the final assembly for sale to the U.S. Military. After assembly and testing, it was determined the units operated as required, Photos 1 and 3-8.
However, when the Shipper was advised to the fact the two (2) units had been transferred to a flatbed trailer after shipment from their facility, and the securing straps had been placed over the top of the units frames, they advised they would not guarantee the units. Thus, they cannot be sold to the U.S. Military without a Warranty/Guarantee.
NATURE/CAUSE OF LOSS:
Possible hidden damages, due to transferring cargo from original trailer to a substitute. Securing restraints had been compromised.
